These Terms of Service govern your access to and use of AI Mail, an email-assistance platform operated by The Computer Specialists, LLC. By creating an account, connecting a mailbox, using the service, or clicking to accept these Terms, you agree to be bound by these Terms.

1. Service Description

AI Mail is designed to help users review incoming email, identify messages that may need a response, generate draft replies, and assist with email workflow. AI Mail is an assistant tool. It does not replace human judgment, professional advice, legal review, business decision-making, or customer-service responsibility.

2. Human Approval Required

AI Mail is intended to prepare draft responses for review. You are responsible for reviewing, editing, approving, rejecting, or sending any message created with the assistance of AI Mail.

No AI-generated message should be treated as final until you or an authorized user on your account approves it. By approving, editing, sending, or allowing a message to be sent, you accept full responsibility for the final content, timing, recipients, accuracy, tone, promises, representations, legal impact, business impact, customer impact, and consequences of that message.

3. User Responsibility for Approved and Sent Messages

You are solely responsible for all emails, replies, communications, statements, offers, commitments, instructions, advice, representations, or omissions that you approve, edit, send, or cause to be sent through AI Mail.

To the maximum extent permitted by law, The Computer Specialists, LLC is not responsible or liable for any loss, claim, damage, dispute, business consequence, legal consequence, customer complaint, reputational harm, financial loss, compliance issue, missed deadline, incorrect statement, or other result arising from an AI-generated message that you review, approve, edit, send, or choose not to send.

4. No Professional Advice

AI Mail may generate text that appears to discuss technical, business, legal, financial, medical, compliance, employment, tax, or other specialized topics. Such text is generated for drafting convenience only and is not professional advice. You are responsible for obtaining advice from qualified professionals before relying on or sending any message involving professional, regulated, legal, financial, medical, employment, or compliance matters.

5. Account Registration

You agree to provide accurate registration information, including your name, email address, company name, and payment information where required. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree not to share your login credentials with unauthorized users, bypass security controls, interfere with the service, or use AI Mail for unlawful, abusive, deceptive, harassing, spam-related, or harmful activity.

6. Mailbox Connection and Data Handling

If you connect an email account, you authorize AI Mail to access that mailbox for the purpose of providing the service. AI Mail may read message metadata and temporarily process message content when needed to analyze whether a response may be appropriate or to generate a draft.

AI Mail is not intended to be a full email archive, compliance archive, or backup system. You should maintain your own email retention, backup, compliance, and recordkeeping systems as needed.

7. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect account and service data. However, no internet-based service, email system, AI system, or connected third-party service can be guaranteed to be completely secure, error-free, uninterrupted, or immune from unauthorized access.

You are responsible for using strong passwords, securing your connected email accounts, reviewing access permissions, and promptly notifying us of suspected unauthorized access or misuse.

8. AI Limitations

AI-generated output may be inaccurate, incomplete, outdated, inappropriate, misleading, too broad, too narrow, or unsuitable for your situation. AI Mail may misunderstand email context, customer intent, tone, attachments, prior conversations, deadlines, legal obligations, pricing, or business policies.

You agree to independently review all AI-generated drafts before approval or sending. You should not rely on AI Mail to detect every urgent message, every customer request, every security issue, every legal matter, or every message requiring action.

9. Trial, Subscription, and Billing

New paid accounts may receive a 14-day trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at $99 per month, plus any applicable taxes or fees.

By providing payment information and starting a trial or subscription, you authorize recurring monthly billing through our payment processor. Payment information is processed by Stripe or another third-party payment processor. We do not store full credit card numbers on our servers.

You are responsible for keeping payment information current. If a payment fails, your account may be suspended immediately or restricted until valid payment information is provided and any outstanding balance is resolved.

10. Cancellation

You may cancel your subscription before the end of the trial to avoid being charged. After paid billing begins, you may cancel future renewals through the billing tools provided, through the customer billing portal when available, or by contacting support.

Cancellation stops future renewal charges but does not automatically refund prior charges unless required by law or expressly agreed by us in writing.

11. Suspension and Termination

We may suspend or terminate access if payment fails, your account is inactive, you violate these Terms, your use creates risk to the service or others, you misuse mailbox access, or continued access may create legal, security, operational, or reputational risk.

Suspension may prevent access to AI Mail features until the issue is resolved. Suspension does not necessarily delete account data immediately.

12. Third-Party Services

AI Mail may depend on third-party services, including email providers, Microsoft services, Stripe, AI model providers, hosting providers, domain providers, and other technology vendors. We are not responsible for third-party outages, policy changes, rate limits, errors, security events, account restrictions, API changes, billing processor issues, or service interruptions outside our reasonable control.

13. Service Availability

We aim to provide a reliable service, but AI Mail is provided on an as-available basis. We do not guarantee uninterrupted access, error-free operation, immediate processing of every email, delivery of every message, or continuous availability of connected services.

14. Prohibited Uses

You may not use AI Mail to send spam, phishing, malware, fraudulent messages, unlawful content, harassment, impersonation, deceptive communications, regulated professional advice without review by a qualified professional, or any content that violates applicable law or third-party rights.

15. Limitation of Liability

To the maximum extent permitted by law, The Computer Specialists, LLC, its owners, employees, contractors, vendors, and affiliates will not be liable for indirect, incidental, consequential, special, punitive, exemplary, lost-profit, lost-revenue, lost-data, business-interruption, reputational, customer-loss, or similar damages arising from or related to your use of AI Mail.

To the maximum extent permitted by law, any total liability arising from or related to AI Mail will be limited to the amount you paid for the service during the three months before the event giving rise to the claim, or $99, whichever is greater. Some laws may not allow certain limitations, so these limitations apply only to the extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless The Computer Specialists, LLC, its owners, employees, contractors, vendors, and affiliates from claims, losses, damages, liabilities, costs, and expenses arising from your use of AI Mail, your connected mailboxes, your approved or sent messages, your violation of these Terms, your violation of law, or your infringement of third-party rights.

17. Changes to Terms

We may update these Terms from time to time. If we make material changes, we may require you to accept the updated Terms before continuing to use the service. Continued use after updated Terms are posted or accepted means you agree to the updated Terms.

18. Electronic Acceptance and Records

You agree that your electronic acceptance of these Terms has the same effect as a physical signature. We may record your acceptance, including the Terms version, timestamp, email address, name, company name, IP address, user agent, and related account information.

19. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. To the extent permitted by law, disputes will be handled in courts located in Massachusetts.
